Dear all,
please help to solve the following issue:
(1) L/C (subj. to UCP500) indicates that docs should be issued in Language A or Language B.
(2) It is also stated that docs issued in Language B are acceptable as presented.
(3) Latest shipment date - 070410
Transport document presented is issued in Language B and shows actual shipment date 070415
Is the presentation discrepant?

Yes, the clause may have not been worded clearly but it could easily be argued that the expressiong "as presented" to mean without translating it to language A. The beneficiary and / or his bank should have requested for clarification at the time of receipt of the LC.
Having said that, I would like to know what type of transport document presented? Is it AWB, B/L or any other transport document? If it is AWB, does the LC requires actual date of shipment to appear on the AWB? If the LC doesn't require actual date of shipment and the AWB date is on or before the latest date of shipment stated in the credit, then by virute of article 27(a)iii of UCP 500, the AWB is not discrepant.
