once again the problem arises from a poorly opened credit. Personally I would inform the issuing bank (and the beneficiary) that I am requesting clarification and that the credit is not available until I get a satisfactory reply

It depends on where the availability was stipulated in the LG. Usually it's at the counters of the issuer, and consequently the documents/claim must be received there at the latest on the expiry date.

It depends on the credit terms. If the credit states "Issuing bank commissions are for beneficiaries" of course they can. Most credits have IB charges for Applicant and all other charges for Beneficiary. In that case, I would say that IB should not claim a payment commission.
