Discounting of Bill of exchange

Dear Joe,

Based on Art2 (who is considered as nominated bank), I would say that 12b does not give any protection to an advising bank.

Sub-article 14(f) - Whether the data content fulfils the fun

Dear Gabriel, I share N.H. Duc's opinion. And my additional arguments are: 1) LC calls for Cert.of cleanliness. Presented document has the same title 2) Doc. also states: "Method of Cleaning : No tanks cleaning was carried out. " - but reason for not taking such actions are not analysed by...

Beneficiary's name

Please take a look at:
1) Official Opinion TA705rev - Unpublished UCP 600
2) Official Opinion R687 / TA646rev - 2005-2008
3) Official Opinion R213 - 1995/96

They might be helpful.

With best wishes,

Is this documentary or non-documentary condition?

I share Daniel's opinion. Moreover, I would add - it depend on what your bank is requested to do with this LC - if, just to advise the LC, then you may draw beneficiary's attention to this specific point and if Beneficiary would like - they would ask for clarification. If you intend to accept some r...

copy of doc not presented

if under field 46 of LC (Documents required), certificate of quality is required in 2 originals and 2 copies, and only 3 originals are presented, thus presentation does not comply with LC terms.

protest for non-payment/acceptance

Hello, 1) It depends on the local law at the place where presenting bank is located 2) Presenting bank first of all shall deliver documents against payment/acceptance. If drawee is not willing to accept drafts and presenting bank ("PB") is not on position to follow "protest instructio...

Draft

Dear Isabella, If draft/bill of exchange is among the documents required in field 46A of the LC, then I would consider documents presented as beeing not in compliance with LC terms, as special condition from LC is not met. I would recommend to take a look at "Analysis" part of ICC official...

CMR - copy for sender

Dear Zeynep, Thank you for your feedback, which is highly appreciated. Conclusions/assumptions are correct. But, frankly speaking, based on the CMR presented, we can not state if requirement in LC for CMR "copy for sender" to be presented, is met or not. As CMR presented does not bear any ...

CMR - copy for sender

Dear Colleagues, I would appreciate if you could share your opinions regarding following issue. LC requires presentation of "CMR, copy for sender - 1 original". Beneficiary presented 1 original CMR, which does not bear any mark/notation "copy for sender" or similar. In upper left...
