Postal Receipt or Courier Receipt

Post by hleung » Fri Aug 24, 2001 1:00 am

In a situation that DC calling for a postal receipt or courier receipt to evident bene. had despatching some documents to the stipulated party,
the postal receipt should be presented in original and courier receipt should be presented with notation copy for sender (usually, is the second page of airway bill issued by the courier service with data contents under carbon production).
Problem: since DC does not specify copy of postal receipt or courier receipt acceptable, in general practice, original document is required, so, it may be regarded as discrepancy if the postal receipt or courier receipt presented in photocopy. Besides, the courier receipt cannot be presented in original due to the origin already accompany with the documents despatched to the receiptent. This is just like the reason why copy for shipper under Airway bill should be acceptable on UCP500 under air transport documents.
Can anybody give comments on the above?

IF YOU CANNOT CHANGE THE UCP, CHANGE YOURSELF TO FILL THE GAP!

If the UCP 500 cannot reflect or otherwise catch up with the trade practices of other industries, bankers should understand such changes in the marketplace and do the necessary things, rather than relying mechanically on an otherwise outdated UCP.

The UCP has exhibited a trend of revision in about every ten years and with this e-commerce age coming so fast, bankers should exercise more flexibility and we are sure that a majority of them are doing this transformation already or they may not survive in the next decade.

We have clients coming to us for such complaints and we usually advise them to talk to their banks: "If you do not serve us well, we would try to go to the one around the corner". This is quite effective, provided you have your muscle. It is most difficult to be a small SME for this reason.

Postal Receipt or Courier Receipt

Since it is known that a postal receipt or courier receipt is not a document of title, there is no added value in the difference between an original and a copy. Therefore the issuing bank should only ask for copies of such documents.

I agree with H Leung that a copy AWB should be acceptable, but it is plain for all to see in Article 27 A v that only the original is acceptable. Since this is known before the AWB is drawn up, it should not be problematic.
