Charterparty B/L versus Ocean B/L

Post by JavedAlim » Sun Mar 12, 2006 12:00 am

I have seen various LCs in which
the requirement of Bill of Lading is " Full set of ocean bill of lading" and additional condition shows Charter Party Bill of Lading is acceptable. Accordingly we receive documents with Charter Party Bill of Lading (in line with UCP article 25.
As per my understanding there is no contradictory between article 23 & 25, therefore, we can accept Charter Party B/L..need further clarification.

Another issue is : LC issued with B/L Clause showing "Full set of ocean Bill of Lading required" and
no indication of Charter Party B/L in the LC. But documents presented with Charter Party Bill of Lading , can we accept this B/L in lieu of Ocean Bill of Lading..
Best regards,
Javed

Charterparty B/L versus Ocean B/L

Dear Javed,

Such credit requirements are often basis for confusion. The way that I see this, is that when you have a choice – you must choose. So that if a Charter party B/L is presented, it should be examined according to article 25. There are of course differences between article 23 and 25 – but as a quick shot (without having checked carefully) I would agree with you that if 23 is complied with – then so is 25.

As for the second one please see UCP 500 sub-article 23(a)(vi): If the document indicates that it is subject to a Charter Party - then you are in breach of article 23. This is not acceptable.

Please bear in mind that article 23 and 25 covers two – by nature – different documents; so it is important that the credit is precise – and that the “correct” document is presented.

Hope this helps you

Best regards
Kim
