Hello to all,
During my last training on D.C. one of the participant explained that she had documents refused on a D.C dealt by a Swiss bank on an exportation to Lybia, because the AWB didn't bear the same date for the issue and the flight date ?
I was not able to give a logical explanation and promised to revert with an answer.
Can anyone provide me with an explanation ?

I do not understand the discrepancy. The documents appear to comply unless there is more to the story. UCP article 27: Where the Credit calls for an actual date of dispatch, indicates a specific notation of such date, the date of dispatch so indicated on the air transport document will be deemed to be the date of shipment.For the purpose of this Article, the information appearing in the box on the air transport document (marked 'For Carrier Use Only' or similar expression) relative to the flight number and date will not be considered as a specific notation of such date of dispatch.
In all other cases, the date of issuance of the air transport document will be deemed to be the date of shipment ISBP paragraph 151 states: If no actual date of dispatch is required by the credit to be shown on the document, the date of issuance of an air transport document will be deemed to be the date of dispatch, even if the document shows a flight date and/or a flight number in the box marked “For Carrier Use Only” or similar expression. If the actual flight date is shown as a separate notation, but is not required by the credit, it will be disregarded in determining the date of shipment. I do not see a discrepancy. It is great to have the rules available on this site.

thank you for your comments, and for sharing my opinion. The fact is that it seems that there is something perticular concerning this deal, the only extra information I have is that the goods shipped are medical product, and for each shipment the officer in charge in Switzerland ask for the AWB to be amended in order to accept documents. I imagine that this is a particularity in Lybia, but I would like to have a logical answer (and here all our rules are not sufficent I went through them before calling for your opinion)

I have been in touch with collegues of the major swiss banks and nobody is aware of any particularity in the case mentioned by you. I have also contacted some forwarders and carriers and the result was identical.
Therefore, with the informations in our hands for this case the AWB would be accepted as per UCP 27
