SIGNATURE ON BILL OF LADING

Hi Everyone,

We have received a B/L , signed in the dotted lines below details of which are given within quotes:

Quote
XXX Transport LLC as Carrier

Mr.ABC Documentation Specialist

BY...................................
Unquote

Is the above B/L signed as per UCP 500 and is it in Order?

Dear Khalid,
My first think was that it is ok but then I reconsidered my point of view:
it is important to know if the b/l is also stamped by the carrier or not. If yes, it is clear that the person that signed is an employee of the carrier. If it isn't stamped you may have doubts concerning who signed the b/l. Is that kind of case under which each part can sustain his point of view without giving up.
You may say it's ok,the person that signed is carrier's employee and doesn't act as an agent because it is not a different entity from carrier.But you can also say that you cannot check if this person is carrier's employee and should have indicated his capacity.
So:
if it is stamped (carrier's name on stamp) is ok.if not is a discrepancy.

Thanks for your contribution. My initial response also was that the B/L has been signed by an employee of the carrier. But since there was no indication that the signature is of an employee signing on behalf of the principal there was enough doubt as to the capacity of the signatory. I have now found out that other documents viz invoice,P/L etc also have been signed by the same gentleman which clearly makes the B/L discrepant.
