Dear all,
some B/L's show beneath the goods description field the following remark or similar: 'above particualrs as declared by shipper' in preprinted form. Now on such a B/L in this field is the on-board notation including port of loading as per L/C terms. In the preprinted field for the port of discharge is only USA seaport shown, but in my opinion not inconsistent with the on-board notation that shows Los Angeles. Now the bank says that the on-board notation is not acceptable as the remark 'above particulars as declared by shipper (or similar) makes the on-board notation invalid.
In kindly ask for your suggestions for that issue.
best regards
Stephan
EDIT: The field on the B/L shows as definition only preprinted remark as: marks and number, description, gross weight etc. (only information about the goods) and the remark itself here exactly again:
Above particulars as declared by Shipper, but without responsibility of or representation by the Carrier (see clause 8).
For your information clause 8 on the back of the B/L is concerns only to the description, quantity and quality of the goods.
