Haven't seen this one yet, but every day is a new day in the documentary credit field I guess.
I have a B/L which bears exactly the following clause for a shipment made in containers :
"cargo on/under deck at shipper's risk".
Personnally I consider that this sentence does not specifically state that the cargo is on deck, but that if it is, the shippers bear the risk.
What do you think? On deck or not?

P.S. This will probably be my last question, since at the end of the month I will be taking a well-deserved retirement, although I hope to remain active in the ICC and see the birth of the UCP 600 after a long period of gestation

Back this week from holiday in la belle France (la Nievre). Good luck with the retirement. Will you be taking your retraite (presumably a la repartition, not that’s any of my business) in France or the U.S.? Incidentally, if I were taking my retirement I would want to try to forget the monde farfelu of the documentary credit asap!
Any way, as to your question I consider that this ‘clause’ falls within sub-Article 31(i), last sentence, and thus does not breach the UCP.
