Hi all,
Your comments on the following are appreciated:
* LC requires:
- Multimodal BL
- 44E: Port of Loading: Port A
- 44F: Port of Discharge: Port B
- 44B: Place of Final Destination: Place C
* BL presented shows:
- Port of Loading: Port A
- Port of Discharge: Port B
- Place of Final Destination: Place B
BL also contains on its face an additional statement: “Goods in transit to the final destination: Place C. All charges (including freight for transport from Port B to Place C) for the consignee’s account.”
Do you think the BL is complying with UCP 600 Article 19 a.iii (a) and the LC?

I cannot pretend I am sure, NHD. If I had to make a decision I think it would be that the BL breaches 14(d).

Not quite sure but I think the described BL does not appear to comply with Article 19 a.iii (a).
What’s more. I wish to draw your attention to the additional statement on the BL: “ … all charges (including freight for transport from Port B to Place C) for the consignee’s account”.
Is the BL acceptable if the applicant buys CFR or CIF Place C , i.e., freight from Port A to Place C is to be prepaid by the shipper/beneficiary ?

NHD, I cannot see the relevance of the Incoterm quoted in the goods description to the compliance of the transport document presented.

Dear Jeremy,
Sorry for my bad interpretation.
L/C requires a multimodal bill of lading to be marked “FREIGHT PREPAID” covering shipment from Port A to Place C as described in my initial post.
A bill of lading presented shows “FREIGHT PREPAID” but also contains an additional statement “…charges including freight for transport from Port B to Place C for consignee’s account”.
Is the presented bill of lading discrepant as per Article 14 (d)?

I am unconvinced that one (in the capacity of a banker involved in doc. credit operations) can assume that the ‘freight’, referred to in requirement that the multi-modal transport document (MMTD) be marked ‘freight prepaid’, includes the cost of carriage from the port of discharge to the place of final destination. I therefore incline to the view that the additional statement does not create ‘data conflict’ with the statement ‘freight prepaid’. Also, I certainly do not think that the Incoterm quoted in the goods description is of any relevance to this question.

Also not relevant but CIF or CFR are not compatible with multimodal transport as we are told these incoterms should be used for port to port shipment only
