partial shipment vs. two B/Ls

Hi;

Under a confirmed credit, where partial shipments were NOT allowed, the beneficiary presented two B/Ls issued by two different carriers indicating the same port of loading, the same vessel name, the same port of discharge and the same date of shipment but different voyage no's.

Could you please provide me with your comments whether voyage numbers should have been the same on these two B/Ls.

To the best of my knowledge, a vessel can have only one carrier for a given voyage. So, I would refuse the documents.

I cannot pretend I am confident as to the answer. I incline to the view that the same vessel, port of loading and port of discharge, and on board date is sufficient of itself to show that all the goods are taking the same ‘journey’ (the key word used in 31(b)) and that different voyage numbers cannot call in doubt these salient (apparent) facts.

Incidentally, I am not worried about there being two carriers as one can be a (contractual) carrier without owning any vessels.
