Evidence of fax transmission

Dear All,

L/C calls for ''a copy of benef's fax sent to applicant's fax no. xxx within 10 days from shipment date advising shipment details''.

The beneficiary presents a document titled 'Shipment Advice' addressed to applicant showing his address, phone, and fax no. xxx and shipment details.

Would you consider this document a copy of the required fax?

Hi,

There is no good reason to reject the document.

If the applicant wants to have evidence of fax transmission, he should require a fax activity report.

It is the "sent to applicant" which annoys me

As I understand the LC requirement, it was for the beneficiary to present a copy of the fax that had been sent to the applicant. The document apparently presented may be a document that the beneficiary INTENDED TO SEND to the applicant but it did not demonstrate that it had actually been SENT. Therefore it is not the document required by the credit.

If an LC called for presentation of a copy of a commercial invoice sent by the beneficiary to the applicant, would the "sent by" language add anything to the examination process?

Is it isbp to require that the sender of a faxed document present a document that shows on its face (or by an apparently accompanying document) that it was faxed?

I would request some evidence that a fax transmission had actually taken place.

In the "good old days" when a telex advice of shipment was required, banks would check that the "answerbacks" on the top and at the end of the message existed since that was the proof that the telex had been sent (and theoretically received)

Therefore for me, it seems logical to require some evidence that the document was actually faxed.

If I were to request a copy of the invoice sent to the applicant, I would also ensure that my credit required at least beneficiary's statement that the invoice had in fact been sent.

What if a copy of email, instead of fax, is required ? Would you accept the shipment advice just showing the required email address under addressee's name ?

Quite so Antoine, the answer being ‘yes’. Similarly if the credit called for ‘a copy of benef's letter sent to applicant's address xxx’ one would accept a copy of the letter without requiring any evidence it had actually been despatched. Surely all that matters is that the document appears to be a copy of a facsimile message. (Without seeing the document I cannot say if it does but I have my doubts.) If the issuing bank/applicant wanted evidence of despatch then they should have asked for it and must live with the consequences of not doing so.
