How the Documentary Credit can Thrive in a Digital Environment

In a wide-ranging overview of the documentary credit’s origins to its future viability, David Meynell is laser-focused on making the case that digital technology has thrust documentary credits into a promising new era primed to offer increased efficiency, transparency, and security.

Released in December 2023 and available on LinkedIn, “From deficient to smart: Unlocking efficiency and transitioning the documentary credit in a digital environment” begins with the early days of credits and a review of the drawbacks of traditional paper-based processes: laborious manual tasks, errors, time delays, and potential for debate regarding possible or alleged discrepancies. Meynell then discusses broad aspects of the digital landscape that will have a transformational impact on documentary credits in several ways.

“There is no doubt that digital technology will enhance the efficiency, security, and transparency of documentary credits”, he posits. The sticking point is at what pace industry stakeholders are capable of confronting and overcoming the challenges and considerations for implementing digitalization to attain those enhancements. Among the most arduous challenges is ensuring that digital documentary credits comply with international trade
laws, data protection policies, and applicable financial regulations.

Meynell then referenced the UN Model Law on Electronic Transferable Records (MLETR) and other laws and jurisdictions that recognize the possibility of possessing electronic documents. He also referred to an effort by the ICC Digital Standards Initiative (DSI) to track worldwide progress toward MLETR implementation. From there, Meynell goes on to discuss the landmark UK Electronic Trade Documents Act (ETDA) and enhancements to the eUCP to align it with MLETR.

He also addressed the importance of standards and an effort aimed at eventually creating a framework where data can be entered once and automatically populated within all necessary documentation. After covering the basics of smart contracts, automation, and the emergence of Generative AI, Meynell outlines the advantages of digitalizing documentary credits. In terms of utilizing smart contracts and Generative AI to seize the advantages, Meynell predicts “the documentary credit will not only endure but will be subject to strategic adaptation, validating its role as a key trade facilitation instrument.”
