Confirmation by second advising bank

Hi,

I would like to add the following: if the L/C is not available with Bank A or with any bank in bank A's country, then bank A is not nominated bank, i.e. is not nominated under UCP to add confirmation, not even "silent".

Silent confirmation

Hello,

Is it correctly understood that UCP600, art 12a provides for a Silent Confirmation?

Thank you in advance for sharing your opinions.

Best regards,
Sladjana S.

UCP Protection

This is an interesting issue. There are customers asking for a such arrangement in order to save a couple of days, i.e. instead of sending the original documents (previously approved by the nego bank) to nego bank for onward transmission to issuing bank, they want to send these direct to the issuing...

Returned documents lost in transit

Thank you for your comment. The L/C in question is available with the advising (nominated) bank, so in accordance with art 35, when the nominated bank sends the documents to the issuing bank, the postal risk is for the issuing bank, but, when the issuing bank returns the documents, and if art 35 app...

Returned documents lost in transit

A reflection: + a L/C available with the L/C advising bank + the L/C issuing bank received and refused documents presented by the advising bank + the L/C issuing bank informed the advising bank that documents have been refused and returned + the documents lost in transit, never reached the advising ...

Name of a bank

Short: + Issuing bank’s name is “The Bank of xxx” + All documents must state issuing bank’s name + All documents state: “Bank of xxx”, i.e. the word THE is missing in the bank’s name Do you assume it as a discrepancy, i.e. that issuing bank’s name stated in documents is incomplete? Thanks in advance...

Certifying occurrence of a future event

I wouldn’t agree. What I am going to say is that the certificate is on its face in compliance with the L/C requirements and that it is not impossible at all that the beneficiary actually had a copy of certificate of origin already on 08/6, but without that it was dated or signed. It may be dated whe...

pre-advised L/C

As per UCP 11b A preliminary advice of the issuance of a credit or amendment ("pre-advice") shall only be sent if the issuing bank is prepared to issue the operative credit or amendment. An issuing bank that sends a pre-advice is irrevocably committed to issue the operative credit or amend...
