Note: Marc Allen (Fraudster) was the leasing and property manager of Harbourtowne House Condominiums (Harbourtowne) in Dunedin, Florida. Fraudster was given limited power of attorney to lease units and manage property by his father William Allen, the property owner (Owner).

With the assistance of Robert Edwards (collectively Fraudsters), Fraudsters forged the signature of Owner, fraudulently granting Fraudsters the right to encumber Harbourtowne. Although, Fraudsters did not possess legal rights to offer Harbourtowne as collateral for a loan or take out a mortgage on the property they offered a mortgage of USD 1,078,000 from Lawrence and Shapiro Lending LLC (Lender 1) on Harbourtowne. Three subsequent loans from Lender 1 totaled USD 776,381.63. Afterwards, to obtain a loan from Bloomfield Institutional Opportunity Fund (Lender 2), Fraudsters forged false documents entitled, "Evidence of Commercial Property Insurance" and "Certificate of liability Insurance" purportedly issued by MOC insurance, though they had never had any business dealings with MOC.

Afterwards Fraudsters forged a standby letter of credit for USD 5,000,000, issued purportedly by East West Bancorp, to help secure the loan from Lender 2, though Fraudsters had never had any contact with East West Bancorp. Fraudsters also filed articles of incorporation for Lender 1 with the Florida Department of State Division of Corporations. By listing Marc Allen as a registered agent, Fraudsters opened a bank account at Bank of America in Lender 1's name that Fraudsters could control. In March 2010 Fraudsters obtained the loan for USD 3,054,778.13 from Lender 2 based on fraudulent collateral and letters of credit intended partially to satisfy the initial loan from Lender 1.

Fraudsters also prepared a fraudulent notice of Voluntary Dismissal and Release of Lis Pendens for the loans from Lender 1, forging the signatures of Lawrence Shapiro (the company's owner) in the process. These documents were prepared by an attorney A.A who did not represented Fraudsters. To further mislead Lender 2 Fraudsters forged a system of fake phone numbers at phone.com purportedly belonging to East West Bancorp and attorney A.A. A notary and the mother of Robert Edwards were also implicit in this plan. The notary knew of the fraudulent document that gave Fraudsters power of attorney and Edward's mother recorded the phony phone messages that mislead the creditors.

Fraudsters were charged and found guilty of criminal fraud. The facts were admitted by Edwards in the evidentiary hearing. Subsequently, Edwards petitioned to vacate or set aside the sentence in a post-judgment motion based on the ground of legal misrepresentation. The U.S District Court for the Middle District of Florida, Moody, J., denied the petition.
