Decline nomination
Shahed You are being far too vague here. I assume you have a case in mind. A bank declining its nomination is not obligated to explain itself noting of course that if a bank has already either confirmed that credit or otherwise expressly committed itself to act outside of confirmation as recognised ...

The application of paragraph A3 ISBP745
I would value the opinion of members on the following point. Paragraph A3 ISBP745 requires statements to be signed and this is expanded on by paragraph A5 ISBP745. Therefore if a credit, not uncommonly, were to require presentation of 'Packing list stating that the goods are packed in five cartons' ...

Mathematical calculations
There is no obligation for you to check any calculations. It all depends on how you view your relationship with your customer and how far you want to go in supporting that relationship. Personally I think you are creating a rod for your own back by doing this unless it is a simple couple of calculat...

LC Number and Date
I assume the basis of your argument is that the credit should ideally have stated that the invoice should evidence 'LC number and LC date'.
Have you ever seen a credit issued like that?
The context is clear in that the date required is the LC date.

If I have surmised correctly you have bill of lading with a dated on board notation which shows the port of loading in accordance with the credit terms but with an asterisk next to the vessel name linking that box to a statement 'intention to load at.....on vessel......'. In my opinion you have to e...

ISBP Article A8
The question posed has the potential to divide respondents, especially given that I cannot recall any published opinion on this subject. Therefore, whilst I might sympathise with your predicament, I do feel we need to fall back on the precise wording of paragraph A8. That paragraph does not distingu...

Release of discrepant documents after L/C expiry - obligatio
Gerhard I cannot see any grounds on which they could avoid responsibility for payment. Doubtless the presentation schedule contained clear instructions that the documents were sent under the protection of the credit and that they were only to be released against payment. Therefore, even if it was fe...

Many of you will have benefitted over the years from the pearls of wisdom that Jeremy has offered to questions raised on DC-PRO. At the end of August, Jeremy will retire from Lloyds Bank and I thought it would be nice to seek your comments and present them to him on his last day. Please note Jeremy ...
