Note: Cheng Man To, Defendant, while a shareholder and director of Oriental Hero Industries Limited, applied for and was granted six LCs issued by Nanyang Commercial Bank Limited and the National Commercial Bank Limited in favor of Post Metal Works. Post Metal Works, owned by coconspirator Chan Chin, submitted false documentation to Issuers, received the proceeds of the LCs, and returned them to Oriental Hero, less the banking fee. There were no genuine underlying transactions.
Defendant was convicted in District Court of conspiracy to defraud and sentenced to two years' imprisonment. Defendant applied for leave to appeal against conviction on grounds of insufficiency of evidence relating to witness testimony brought against him at trial. In dismissing Defendant's application, the High Court of the Hong Kong Special Administrative Region Court of Appeal, Stock, JA., cited testimony from the trial and ruled that the evidence was sufficient to find conspiracy to defraud.
