Note: The Alberta Court of Appeal, Cote, Wittmann and Costigan, JJ., dismissed an appeal from a decision of the Alberta Energy and Utilities Board denying a request by Atco Electric Ltd. to include a management fee in its tariff for regulated utility charges for electricity.

The reason given for the requested increase was to cover the CA$488,000 cost of an LC. In refusing, the court noted that no tangible evidence indicating costs had been presented and, even had it been presented, the question would still need to be addressed as to whether the cost was prudent under applicable regulations.
