Note: In Credit Suisse First Boston Mortgage Capital, LLC v. Danning, Gill, Diamond & Kollitz, 178 Cal. App. 4th 1290 (Cal. App. 2d Dist. 2009), the appellate court reversed and remanded for further proceedings to determine whether an LC transaction had occurred. This opinion represents the remand. No LC transaction was found on remand so that California Code of Civil Procedure §697.740(j) did not apply and the Credit Suisse opinion constituted the law of the case not subject to relitigation.
