2011 LC CASE SUMMARIES [2011] HKCU 508 [HONG KONG]
Topics: Injunction; Security; Mareva Injunction; Freezing Order
Article
Note: In connection with a lawsuit, Plaintiff, Hui Chi Ming, applied for and was granted a Mareva injunction against Second and Third Defendants, which froze their assets. After the court granted the Mareva injunction, Plaintiff liquidated his entire shareholding from his company allegedly worth HK$3 billion and resigned as Chairman and Executive Director, and nothing is known of the proceeds. To protect themselves, Defendants applied to the court for an order requiring Plaintiff to provide security by way of paying money into the court or a bank guarantee. Burrell, J., granted Defendants' application for security by bank guarantees with Plaintiff as Applicant and the court as Beneficiary in the amounts of HK$6 million and HK$6 million.
