Note: Quiana Norris sued Jackson Hewitt (Tax Preparers) alleging that it violated the Ind. Code 24- 5-15-1, et seq., when it prepared her income tax return. Ind. Code 24-6-15-1, et seq., requires a company to obtain a surety bond or irrevocable letter of credit before doing business as a credit services organization in Indiana. The relevant text of the Ind. Code 24-6-15-1, et seq. provides that "A person that is damaged by a credit services organization's violation of this chapter may . . . bring an action to recover the greater of two (2) times the amount of actual damages or one thousand dollars ($ 1,000) and attorney's fees." The U.S. District Court for the Southern District of Indiana, Indianapolis Division, Lawrence, J., granted Tax Preparers' motion for failure to state a legally cognizable claim.
