ICC Court's Belt & Road Commission: Going Forward
The ICC Belt & Road Commission (‘Belt & Road Commission’) aims to raise awareness of, and building on, ICC’s reputation as a globally trusted dispute resolution service provider. With Justin D’Agostino as its first chair in 2018, the reins of the Belt & Road Commission were handed over in March 2020 to Robert Pé and Susan Munro. In June 2022, under the leadership of Claudia Salomon, President of the ICC International Court of Arbitration, Tengqun Yu (Vice President and General Counsel, China Railway Group) was appointed to take the Belt & Road Commission forward post-pandemic and strengthen knowledge of the important role ICC dispute resolution services can play for mainland Chinese parties involved in Belt and Road Initiative disputes.

Ten Tips on How to Make an Arbitration Award Work: Lessons from the ICC Scrutiny Process
During the 2021 New York Arbitration Week (NYAW), members of the ICC International Court of Arbitration (‘Court’) provided ten practical tips on how to improve the quality and enforceability of arbitral awards. These tips were based on frequent issues that arise during the scrutiny of draft awards. The discussion demonstrated the value of the scrutiny process to parties and identified common pitfalls encountered by arbitrators when drafting awards.

Organised as part of California’s inaugural International Arbitration Week, this ICC Young Arbitration and ADR Forum (YAAF) event featured in-house counsel, arbitrators, and outside counsel who shared ten tips on how to better align the arbitration process with businesses’ expectations. 10th ICC MENA Conference on International Arbitration
For its tenth edition, the ICC MENA annual conference ‘International Arbitration in MENA: Navigating the Latest Developments on international arbitration’ reunited over 200 participants from 20 countries in Dubai. The fireside chat hosted by Claudia Salomon, ICC Court President, was followed by discussions on latest trends in the region, jurisdiction and admissibility, the arbitrator’s authority to revise the contract, and why consider expert determination for dispute resolution. The next ICC MENA Conference will take place in Abu Dhabi on 20-22 February 2023.

LATAM Arbitration under Scrutiny – A Challenge to Legitimacy?
Following a series of events taking place virtually, the annual ICC Arbitration event returned to Miami. This year’s conference addressed regional developments in international arbitration, the power of arbitrators to review contracts, diversity, the distinction between jurisdiction and admissibility and more. An ICC YAF discussion reflected on the future of international arbitration in the hands of the next generation. The 20th edition of the ICC Miami Conference is set to take place in person on 27-28 October 2022.

ICC - FIDIC Conference on International Construction Contracts
In October 2021, the ICC and the International Federation of Consulting Engineers (FIDIC) held their annual ICC-FIDIC Conference on International Construction Contracts virtually. The Conference addressed the increased use of FIDIC contracts and their interpretations, dispute avoidance and resolution, decision enforcement and the future of construction arbitration. Participants from 65 countries attended the online sessions and actively engaged in multiple Q&A discussions and poll voting. The next edition of ICC-FIDIC Conference will take place on 14-15 October 2022 in Dubrovnik, Croatia.

Legal essentials for start-ups
In May 2021, ICC released a new set of model contracts to help global entrepreneurs establish their ventures on a solid legal foundation while reducing legal costs: the ICC Model Contracts for Start-ups. The package comprises: Model Term Sheet, Model Shareholders Agreement, Model Directors Services/Management Agreement, Model Employment Agreement, Model Confidentiality Agreement, and a Checklist on IP assignment and licensing. To help entrepreneurs use the new models, ICC hosted virtual SME Labs, focused on the new start-up models: ‘Starting to negotiate’ (on 25 May 2021) and ‘Organising your company’ (on 2 June 2021).

9th ICC MENA Conference on International Arbitration
The 9th edition of the MENA regional conference featured discussions on the legal environment and various judicial approaches in the region, the role of experts in infrastructure cases and the opening of the fifth ICC Court Secretariat’s case management office in Abu Dhabi. The 10th ICC MENA Conference, which will also feature an ICC Institute training on dispute boards, will take place on 21-23 February 2022.

5th Africa Conference on International Arbitration Arbitration in Africa: Expanding the Scope
The 5th ICC Africa Conference featured a wide variety of topics relevant to the African region, with thirteen panel sessions (plenary and parallel breakout sessions) to take out the most of these two days. The message resonating through it all was that Africa is ready to take its place on the international arbitration scene. The 6th ICC Africa Conference will take place in Lagos on 1-3 June 2022.

6th ICC Asia Conference on International Arbitration
The 6th Annual ICC Asia Conference, which was held virtually for the second year, brought together speakers from Asia and across the world to discuss the ‘future of arbitration’ and the evolving role of expert evidence in arbitration. 5th ICC European Conference on International Arbitration
In its 5th year, the ICC European conference remained a great opportunity for arbitration professionals wanting to keep in pace with latest developments and key trends in international arbitration across Europe. Its traditional opening session ‘a year in review’, was followed by an interview with Professor Georges Bermann, a panel on business and human rights arbitration, and an entertaining series of Oxford-style debates. ICC also paid tribute to its outgoing president, Alexis Mourre, and welcomed President-Elect, Claudia Salomon. The 6th ICC European Conference will be held on 28 March 2022.

36th ICC SIA & QMUL Annual Joint Symposium of Arbitrators: Variations of Hardship and International Disputes
The ICC Institute of World Business Law (ICC Institute) and the School of International Arbitration of Queen Mary University of London (QMUL) held their annual joint symposium of arbitrators on the issue of Variations of Hardship and International Disputes. The two-day webinar dealt with hardship situations in international commercial and investment arbitration, and provided a comparative analysis of the available remedies, the legal grounds that may be invoked by states (including state of necessity and police powers), and the impact of hardship arguments on the management of arbitral proceedings.

ICC YAF: Access to Arbitration in Africa and Disputes Arising in the Extractive Sector
The ICC YAF webinar was dedicated to a region and sector widely represented in investment arbitration. The first panel addressed access to arbitration – i.e. the possibility to take part in an arbitration proceeding as a (disputing) party – from the perspective of State-owned entities and third parties and amicable dispute settlement in the extractive sector. The second panel discussed the performance of extractive contracts, force majeure, change of law by host states, and issues of public interest.

Building on the findings of the ‘Institut de Droit International’ 2019 Resolution, the panel discussed several issues relating to the principle the ‘equality’ of the parties in investment arbitration, such as the effect of a state’s criminal law powers on the arbitral process, a state’s right to file counterclaims and parties’ equality in the composition of international investment tribunals.

QMUL/PwC Study on Damages in International Arbitration
In December 2020, ICC hosted a webinar, moderated by Živa Filipič (Managing Counsel, ICC International Court of Arbitration), to launch the QMUL/PwC Study on Damages in International Arbitration. The online ICC YAF event was organized in the context of the arbitration law reform in Albania and addressed the types of arbitration regimes, i.e. dual arbitration systems (where different regimes apply to international and domestic cases) as compared to uniform systems. Panelists from Albania, Kosovo, France, the UK and the USA discussed the reasons for countries to opt for one system or another, and how each regime operates in practice.

AAA-ICC-ICSID 36th Joint Colloquium on International Arbitration
One of international arbitration’s premier events goes virtual for the first time in its long running history. New Zealand’s University of Auckland took victory in the 16th edition of the ICC International Commercial Mediation Competition in an all-woman final against Bulgaria’s University of Sofia. ICC-FIDIC Conference on International Construction Contracts

15th ICC Mediation Competition – Professionals Roundtable
The ICC Mediation Competition, which involved 66 university teams of students from 33 countries in 2019, also provides an opportunity for over 130 professionals originating from over 30 jurisdictions to gather, act as mediators or judges, network, and benefit from each other’s experience. As part of that effort, ICC held a Professional Roundtable co-organised with the International Academy of Mediators to address the new Singapore Convention and how emotion (of both mediator and the parties) can influence a mediation. 3rd ICC India Arbitration Day
On 14 September 2019, over 280 delegates and speakers gathered in the ballroom in Hyatt Regency, New Delhi to attend the 3rd ICC India Arbitration Day. This report first summarizes panel discussions on corruption in international arbitration (the power of arbitral tribunals to examine corruption-related issues, the appropriate standard of proof required for establishing corruption and the impact on the enforcement of arbitral awards). The report then addresses guerrilla tactics (the increasing ethical misconduct and deployment of dilatory tactics in arbitral proceedings, and the possible ways to combat such tactics). In the final section, the report covers the discussions on the recent amendments to the Arbitration and Conciliation Act, 1996.

ICC Institute Training on the Production of Documents
The ICC Institute of World Business Law (http://www.iccwbo.org/icc-institute) provided a one-day course on the procedural strategies to consider during document production in international arbitration and the use of electronic documents. Through a series of mock case scenarios and reference to rules, reports and soft law providing guidance on the matter, the participants also studied the process and techniques to obtain documents in possession of third parties, the protection of privilege and commercial confidence, and the role that data protection laws play in the disclosure.

International Arbitration of Life Sciences Disputes: Key Issues and Best Practices
Conna Weiner (Arbitrator and Mediator; Vice-Chair, Northeast Arbitration Subcommittee, USCIB/ICC USA), with assistance from Fitch Law Partners, reports on the ICC and USCIB evening program panel, which revealed great interest in the topic. The life science industry (pharmaceuticals, medical devices, diagnostics, vaccines and related businesses) is growing and complex issues arise from international licensing sales contracts, research and development agreements, and joint ventures. The panel addressed why international arbitration is the preferred dispute resolution mechanism for life science disputes and covered the international transactions/ventures and arbitration procedure from a wide variety of perspectives, including outside and in-house counsel, arbitrators, experts and arbitral institutions.

Understanding Chinese State-Owned Entities

4th ICC Asia Conference on International Arbitration
The Conference was one of the numerous events celebrating 10 years of ICC presence in Asia, since the opening of the Hong Kong case management office in 2008. New Edition of Report on Information Technology
The ICC Commission on Arbitration and ADR's Task Force on the Use of Information Technology in International Arbitration first reported on this subject in 2004 under the leadership of Erik G.W. Schäfer and David B. Wilson. Since then, the use and acceptance of IT in international arbitration has substantially increased, especially following advances in technology that have led to solutions that were not available in 2004. This has prompted the Task Force to revise and update their report on ‘Issues to be Considered when Using IT in International Arbitration’, which is accompanied by an updated appendix containing sample wording dealing with the use of IT that may be adopted by parties and arbitrators at various stages of an arbitration.

ICC Court to Start Operating in Brazil
As widely announced last year by President Alexis Mourre, the ICC International Court of Arbitration will open an office of its Secretariat in São Paulo.The new office, which is expected to be fully operative within the first half of 2017, will handle cases related to Brazil and be run by a team of Counsel and Deputy Counsel yet to be designated.
